Owner agreement
OwnStay Platform Terms of Service
Version 2026-09-05-v1 · Effective September 5, 2026
Attorney review required. This production contract framework is intentionally versioned and enforceable in the application, but the provisions identified below for indemnification, liability limitations, governing law, dispute resolution, and warranty disclaimers must be reviewed and finalized by qualified counsel before OwnStay represents them as attorney-approved legal terms.
1. What OwnStay provides
OwnStay provides software and direct-booking technology for independent short-term-rental owners and operators. OwnStay is not the property owner, lodging operator, property manager, real-estate broker, insurer, safety inspector, tax adviser, or guarantor for a property listed through the service.
The property owner or operator remains the lodging provider and is responsible for the accommodation and the guest relationship unless a separate written agreement expressly states otherwise.
2. Owner authority and legal compliance
You represent that you have authority to offer every property you place on OwnStay. You are responsible for maintaining all licenses, permits, registrations, zoning approvals, property rights, lease permissions, homeowner-association or condominium permissions, and other authority required to operate the property as a short-term rental.
You are responsible for complying with applicable federal, state, county, municipal, fire, building, lodging, accessibility, consumer-protection, and short-term-rental requirements. OwnStay's review of documents or readiness information is not a legal determination or certification that a property complies with every applicable law.
3. Property condition, safety, insurance, and operations
You are responsible for the physical condition, maintenance, cleanliness, security, safety equipment, occupancy limits, amenities, contractors, employees, cleaners, guests, visitors, and activities at your property. You must maintain insurance appropriate for your property and short-term-rental activity.
OwnStay does not inspect a property and does not guarantee that a property, amenity, contractor, guest, or operating practice is safe or suitable.
4. Listings and guest contracts
You are responsible for ensuring that listing descriptions, photographs, availability, pricing, policies, fees, taxes, rules, cancellation terms, and other guest-facing information are accurate, lawful, and not misleading. The rental agreement for lodging is between the applicable property owner/operator and the guest, not OwnStay.
5. Payments, taxes, and subscriptions
OwnStay software subscription billing is separate from guest lodging payments. Where Stripe Connect is enabled, the property's connected payment account is used for the property's guest-payment flow. OwnStay does not promise any booking volume, occupancy, revenue, payout amount, or tax result.
You are responsible for determining, collecting, reporting, and remitting lodging, sales, tourist-development, occupancy, and similar taxes unless OwnStay separately agrees in writing to provide a specific tax-remittance service.
6. No guarantees
OwnStay does not guarantee bookings, occupancy, revenue, guest conduct, property condition, legal compliance, tax treatment, availability of third-party integrations, uninterrupted service, or a particular business outcome.
7. Account security and acceptable use
You are responsible for maintaining accurate account information, protecting access to your account, assigning appropriate team roles, and using OwnStay only for lawful properties and lawful business activity. You may not use the service to misrepresent a property, evade licensing or tax obligations, process unauthorized payments, infringe third-party rights, or facilitate unlawful activity.
8. Suspension and compliance controls
OwnStay may suspend or restrict publication, guest-payment capability, integrations, or account access when reasonably necessary to address security concerns, payment-provider requirements, suspected misuse, missing compliance information, legal obligations, or material violations of these Terms. OwnStay will preserve reasonable access to legally required account or billing functions where applicable.
9. Attorney-review provisions
Attorney review required before final wording: indemnification; limitation of liability; consequential and special damages exclusions; warranty disclaimers; governing law; venue; arbitration or other dispute-resolution procedure; class-action waiver if any; notice mechanics; and survival language.
Until those clauses are finalized by counsel, OwnStay will not describe this page as attorney-approved and will not rely on unfinished placeholder language to expand rights beyond applicable law.
10. Electronic acceptance and updates
When you affirmatively check the agreement box and create or continue an OwnStay owner account, you consent to use an electronic record for these Terms and agree to the version identified above. OwnStay records the version and fingerprint of the Terms accepted, together with acceptance time and security/audit metadata.
If OwnStay makes a material change, a new Terms version may require affirmative re-acceptance before specified platform actions can continue. Historical acceptance records are retained and are not rewritten when a later version is published.
11. Privacy
Use of personal information is described in the OwnStay Privacy Notice. Property owners are separately responsible for guest-data obligations that apply to their lodging business.
